Aluminium extrusion and galvanised steel escape Australia's anti-subsidy duties

Australia’s Anti-Dumping Commission (ADC), under the Australian Department of Industry, Innovation and Science, has decided to terminate investigations and to not impose anti-subsidy duties on aluminium extrusion and zinc coated (galvanised) steel exported to Australia from Vietnam.

ADC initiated the anti-dumping and anti-subsidy investigations into aluminium extrusion and galvanised steel imported from Vietnam in August and October of 2016.

Vietnam was accused of subsidising aluminium businesses in three programmes related to tax incentives. Following the investigation, the ADC determined that one out of three investigated Vietnamese companies did not receive any incentive from the aforementioned programmes.

The two companies and other producers/exporters received subsidies but the margin of subsidies was negligible. Therefore, the ADC decided to terminate the subsidy investigation into Vietnamese aluminium.

In the case of galvanised steel, Vietnam was accused of subsidizing enterprises in 19 programmes related to tax incentives, investment incentives, support programmes and trade promotion programmes.

Following the investigation, the ADC determined that Vietnamese companies only received subsidies from three out of the 19 programmes mentioned which is negligible. Therefore, the ADC decided to cease the subsidy investigation into Vietnamese galvanised steel.

The Vietnam Competition Authority (VCA), under the Ministry of Industry and Trade said that the termination of ADC investigations into aluminium extrusion and galvanised steel imported from Vietnam is a positive result and a success for the Vietnamese Government and enterprises.

In particular, the ADC's decision has created a positive precedent for future litigation related to trade defence, VCA stated.
